The Hospital Outpatient Prospective Payment and Ambulatory Surgical Center Payment Systems and Quality Reporting Programs Final Rule has been published in the Federal Register today, November 21, 2018. The Final Rule is available here.

As stated in the Rule, CMS plans continue the voluntary participation period for OAS CAHPS throughout 2019. The next update (CY 2020 Rule) will be proposed in July and finalized in November 2019. The CY 2020 Rule will reflect any changes that would impact the 2020 data collection period (CY 2022 payment determination).

The Hospital Outpatient Prospective Payment and Ambulatory Surgical Center Payment Systems and Quality Reporting Programs CY 2019 Final Rule notification has been posted on CMS' website. The notification provides a preview of what will be posted in the Federal Register. The notice is available here.

As noted in the Proposed Rule (published in July 2018), CMS proposes to continue voluntary participation in the Outpatient and Ambulatory Surgery Consumer Assessment of Healthcare Providers and Systems (OAS CAHPS) Survey Based Measures OP-37a-e/ASC-15a-e, until further action in future rulemaking. Therefore, OAS CAHPS will continue with voluntary reporting throughout 2019.

The Hospital Outpatient Prospective Payment and Ambulatory Surgical Center Payment Systems and Quality Reporting Programs CY 2019 Proposed Rule has been published in the Federal Register today, July 31, 2018. The Proposed Rule is available on the OAS CAHPS website at the link provided here.

In this Proposed Rule, CMS proposes to continue voluntary participation in the Outpatient and Ambulatory Surgery Consumer Assessment of Healthcare Providers and Systems (OAS CAHPS) Survey Based Measures OP-37a-e/ASC-15a-e, until further action in future rulemaking. If approved in the Final Rule (to be published in November 2018), this means that OAS CAHPS would continue with the voluntary reporting throughout 2019.

A preview (or "unpublished" version) of the Proposed Rule is available through the link provided here.

In this Proposed Rule, CMS proposes to continue voluntary participation in the Outpatient and Ambulatory Surgery Consumer Assessment of Healthcare Providers and Systems (OAS CAHPS) Survey Based Measures OP-37a-e/ASC-15a-e, until further action in future rulemaking. CMS will continue to analyze the national implementation data and consider any necessary modifications to the survey tool and/or CMS systems.

In this Proposed Rule, CMS proposes to delay implementation of the Outpatient and Ambulatory Surgery Consumer Assessment of Healthcare Providers and Systems (OAS CAHPS) Survey Based Measures OP-37a-e/ASC-15a-e beginning with the CY 2020 payment determination (2018 data collection) until further action in future rulemaking. If approved in the Final Rule (to be published in November 2017), this means that OAS CAHPS would continue with the voluntary reporting throughout 2018.

In response to comments from facilities and stakeholders, CMS is proposing the delay to gain additional time to:

As per The Final Rule on page 79,810 of the Federal Register / Vol. 81, No. 219 / Monday, November 14, 2016 / Rules and Regulations (Final Rule), an ASC that qualifies for the exemption from the Ambulatory Surgical Center Quality Reporting (ASCQR) Program because it had fewer than 240 Medicare claims (Medicare primary and secondary payer) in the year prior to the data collection year for the applicable payment determination, would also qualify for the exemption from the OAS CAHPS Survey for the same time period. In accordance with the Final Rule, these ASCs are not required to submit a participation exemption request form for the OAS CAHPS Survey for the same time period.

Note that this rule is combined with other programs. Documentation of the OAS CAHPS Survey and the applicable payment determination for Medicare-certified hospital outpatient departments (HOPDs) begins on page 465, and documentation for ambulatory surgery centers (ASCs) begins on page 521. This Proposed Rule indicates the voluntary reporting period for the OAS CAHPS Survey will continue through 2017.
